By accessing https://kapscape.com, submitting an inquiry, making a payment, or engaging Kapscape for any service, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this website or engage our services.

Kapscape is a personal photography and visual content brand operated by Kapil Arora, based in India. Services include hotel and hospitality photography, UGC content creation, real estate and architecture photography, lifestyle, portrait, boudoir, and product photography.

Bookings and Payments
Booking Confirmation
A booking is confirmed only upon receipt of full payment or an agreed deposit through our Cashfree payment links. Inquiries and verbal discussions do not constitute a booking. Kapscape reserves the right to accept or decline any project at its sole discretion.

Payment
All payments are processed through Cashfree Payments, an RBI-authorized payment aggregator. By making a payment, you also agree to Cashfree's Terms of Service available at https://www.cashfree.com/legal/. Kapscape does not store your card or banking details at any point.

Pricing
All prices are quoted in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Prices are subject to change without notice. The price quoted at the time of booking will be honored for that booking.

Deposits
For projects requiring advance planning or travel, Kapscape may require a non-refundable deposit to secure the date. The deposit amount will be communicated at the time of booking.

Cancellation and Rescheduling
Cancelled by Client
If you cancel a confirmed booking:
More than 14 days before the session date: any deposit paid is non-refundable, but the remaining balance will not be charged.
Within 14 days of the session date: 50% of the total project fee is payable.
Within 48 hours of the session date or no-show: 100% of the total project fee is payable.

Rescheduling by Client
One reschedule request is permitted without penalty, provided it is made at least 7 days before the original session date and is subject to Kapscape's availability. Subsequent reschedule requests or requests made within 7 days of the session will be treated as a cancellation and rebooked as a new session.

Cancelled by Kapscape
In the unlikely event that Kapscape must cancel a confirmed booking, you will receive a full refund of any amounts paid. Kapscape is not liable for any additional costs incurred by the client as a result of the cancellation.

Force Majeure
Neither party is liable for failure to perform due to circumstances beyond reasonable control, including but not limited to natural disasters, illness, civil unrest, or government restrictions. In such cases, Kapscape will work with you to reschedule at the earliest available date.

Intellectual Property and Copyright
OWNERSHIP
All photographs, videos, and other creative content produced by Kapscape remain the intellectual property of Kapil Arora and are protected under the Copyright Act, 1957 (India). Kapscape retains full copyright over all work produced, regardless of who commissioned it.

License to Client
Upon receipt of full and final payment, Kapscape grants the client a non-exclusive, non-transferable license to use the delivered images and content for the purposes agreed upon at the time of booking, as outlined below.
Commercial Projects (Hotel, Brand, Product, Real Estate Photography) The client receives a license for digital and print use including websites, social media, OTA listings, marketing materials, and advertising, for the duration agreed at time of booking. Usage beyond the agreed scope (such as resale, sublicensing, or use in third-party campaigns) requires prior written permission and may attract additional fees.
Personal Sessions (Portrait, Boudoir) The client receives a license for personal use only, including sharing on personal social media and printing for personal use. Commercial use of personal session images is not permitted without prior written agreement.

Kapscape Portfolio Rights
Kapscape reserves the right to use images from any project in its portfolio, website, social media, and promotional materials, unless the client requests otherwise in writing prior to the session. For boudoir sessions, images will not be shared publicly without the explicit written consent of the client.

No Alteration
The client may not alter, heavily filter, crop in a way that misrepresents the original, or apply edits that fundamentally change the nature of the delivered images without prior agreement.

Delivery of Work
Kapscape will deliver the final edited images or content within the timeline agreed upon at the time of booking. Typical delivery timelines will be communicated before the session. These timelines are estimates and may be affected by project complexity, volume, or unforeseen circumstances. Kapscape will communicate any delays promptly.
Deliverables will be provided in the agreed digital format via a shared online link or file transfer. Kapscape is not responsible for files after they have been delivered to the client.

Obtaining any necessary model releases, property releases, or permissions for third parties involved in the shoot
Reviewing and requesting changes to edited deliverables within 14 days of delivery. After this period, the project is considered complete
The client is responsible for:

Kapscape treats all client information with discretion. For boudoir sessions in particular, all personal information and images are kept strictly confidential and will not be shared, published, or used in any form without the client's explicit written consent.

Limitation of Liability
Kapscape's total liability for any claim arising from or related to a project shall not exceed the total fees paid by the client for that specific project.
Kapscape is not liable for:
Indirect, incidental, or consequential losses
Loss of revenue or business opportunities resulting from delays in delivery
Damage to or loss of equipment, props, or materials belonging to the client
Results that differ from references or mood boards due to differences in location, lighting, or subject conditions on the day
Kapscape's total liability for any claim arising from or related to a project shall not exceed the total fees paid by the client for that specific project.

Third-Party Services
Kapscape may recommend or engage third-party vendors, locations, or service providers as part of a project. Kapscape is not responsible for the performance, quality, or conduct of any third-party vendor.

Governing Law and Dispute Resolution
These Terms are governed by the laws of India, including the Indian Contract Act, 1872, the Copyright Act, 1957, and the Consumer Protection Act, 2019.
In the event of a dispute, both parties agree to first attempt resolution through direct communication. If a resolution cannot be reached within 30 days, the dispute shall be subject to the exclusive jurisdiction of the courts in India.
These Terms are governed by the laws of India, including the Indian Contract Act, 1872, the Copyright Act, 1957, and the Consumer Protection Act, 2019.
